Making Money Opportunities


Embracing New Opportunities Is Being Defeatist?

A few months back a columnist for the Guardian, Helienne Lindvall wrote a laughably confused argument claiming that people who explained how "free" was an important element of a business model should not be trusted because they also made money. That made no sense, and lots of people explained why. She also got an awful lot of the basic facts wrong.



Lindvall is back, and rather than admitting her mistakes, she tries again, but comes across as even more confused and factually-challenged. The majority of the piece is about setting up more strawmen to knock over, with the two key ones being (1) that supporters of embracing new business models are "defeatist" because they suggest that file sharing cannot be stopped and (2) that while record labels may have ripped off musicians in the past, the companies ripping off musicians today are the "web 2.0" companies that are making money on content -- such as Google, Flickr and others.



Neither argument makes much sense when held up to any scrutiny. Lindvall seems to make the same mistake she made in her first piece (for which, I do not believe she has yet apologized). She takes a tiny part of an argument that someone has made, and pretends it's the entire argument. Just like she claimed that those who embrace free as a part of their business model are somehow being hypocritical in making money elsewhere, she now claims that people's entire argument is based on a tiny sliver of their argument, and ignores the important part.



The problem with her first strawman is that people aren't saying be "defeatist," and just accept that file sharing is file sharing and give up. They're saying that if file sharing isn't going away, and (here's the part she misses) you can use that to your advantage to make more money, why bother worrying about file sharing as being some sort of evil? The second strawman is a bit more nefarious, but goes back to the fallacy that web 2.0 sites are some sort of digital sharecropping, with the users "giving up everything," and the content creators getting nothing. That, of course, is hogwash. The reason people use these services is that they get something in return. What people like Lindvall forget or ignore is that in the days before YouTube, if you wanted to post your own video, you had to (a) buy expensive media serving software from the likes of Real Networks (b) install the crappy software and maintain it (c) host the files yourself, costing you server space (d) stream or download the files yourself, costing bandwidth. Then YouTube came along and made all of that both easy and free -- and you still want to complain that they're ripping you off? Seriously?



Fine: let's make a deal. For any project that Helienne Lindvall is involved in, she cannot make use of these tools which offer free services. Instead, she must set up the technology on her own server, and host and pay for all of it herself. Otherwise, she's just supporting the digital sharecroppers, right?



There are a few other whoppers in the article as well, such as this one:


Doctorow pointed out that numerous authors give away their work, while earning good money on the lecture circuit. I don't doubt that this model works for some authors, but there are fundamental differences between books and music.



Producing a record -- as opposed to writing most books -- tends to be a team effort involving a producer (sometimes several of them) and songwriters who are not part of the act, studio engineers and a whole host of people who don't earn money from merchandise and touring -- people who no one would pay to make personal appearances.

I love the "but we're different!" argument, because it comes up in every industry. I was just in Hollywood, where I explained how musicians were actually making use of these models and someone got upset and said "but we're the movie industry, and we're different!" Earlier this year, I met with a publisher, who also was looking at these models, and again exclaimed that "but book publishing is different!" Everyone wants to believe they're different, but everyone faces the same basic economics. Also, I'd imagine that my friends in the publishing industry would be pretty upset with Lindvall's false claim that a book is not a team effort. You have publishers and editors and agents, all of whom often take on quite similar roles to producers and songwriters and engineers.



That said, the really ridiculous part of her complaint here is that the same people she complains don't earn money from merchandise or touring also don't earn money from record sale royalties for the most part. There are some exceptions, but most of them are paid a flat-fee for their work, and that doesn't change either way under the new models, so her complaint here doesn't make sense. If a content creator can make money giving away some works for free, they can still afford to pay the fees for those who help out. The entire argument that an engineer "doesn't tour" is specious. The engineer doesn't make money from CD sales either.



Finally. Lindvall must be the first person to describe Jaron Lanier as an optimist, since he came out with his incredibly pessimistic book about how the internet was destroying everything good and holy in the world.

Remember Stan Van Gundy and that Miami debacle?

After realizing the Heat had to rebuild, Riley dropped the title of head coach, pegged Stan Van Gundy to take over and took a seat in the front office.

In fact, Riley was the front office executive responsible for bringing Shaq over to the Heat.  He was able to rebuild on the fly with Shaq's acquisition, along with key free agent signings.

But after some trials and tribulations during Van Gundy's tenure with a more talent-laden roster, Riley pulled the plug right away.  He couldn't resist the lure of coaching a championship caliber team.

That's the reason he helped them win the NBA Title in 2006.  But the joy was short lived, as that team was slowed by injuries the following season and Riley promptly stepped down. 

Now that the team has reloaded once again.  Who knows, he may just take over again and dump Spoelstra if things turn bad again in Miami.

Money Making Secrets





Over the past two weeks we've upped our budget travel coverage here at Gadling. We've published stories on budget-friendly Caribbean destinations, budget-friendly European destinations, Thanksgiving hotel deals, hardcore budget travel suggestions, New York City budget travel tips, local budget travel secrets, cheap local fast food worldwide, great sites for planning budget-friendly European travel, and how to find affordable ski deals.



Our recent hyperactivity around budget travel is no accident. We want to improve Gadling's standing as budget travel resource, as a go-to site for budget travel tips, information, and inspiration.



In order to give this new resolve some oomph, a Gadling budget travel manifesto is in order. The goal here is to intervene in a travel media landscape that sees luxury travel as the universal objective of all travelers by glorifying budget travel and budget travelers. Budget travel is exciting and sophisticated and it needs to be recognized as such.



The lure of aspirational travel



People love to read about expensive resorts and impossibly dear travel accessories because they're exciting to contemplate. In this respect, they fulfill a function not a million miles from pornography. And like porn, they're also a lot of fun. The problem is that just as pornography does not provide a good map for most human relations, aspirational travel does not offer a useable guide for most forms of travel. Worse yet, aspirational travel often comes to cloud impressions of travel and actually convince many, many people that travel is an endeavor that can only be engaged at unmanageably high price points.



The focus on aspirational travel in the travel media creates all sorts of strange situations. Reading through a typical American travel magazine or even the weekend travel section of big newspaper, one might believe that $500 per night is a reasonable mid-range rate for a night's hotel accommodation. Honestly, this is outrageous. When push comes to shove, how many people can actually afford such rates?



Budget travel can mean many things. It can mean finding a deal on a hotel, cruise, or air journey. It can mean traveling with very little money and simply making do. It can mean organizing travel around friendship networks, or joining home exchange or couchsurfing membership programs. But however it might be defined, it doesn't include hotel rooms that run $500 per night.



Budget travel is sophisticated travel



Here are three assertions about budget travel in general and in relation to luxury travel that might at first seem counterintuitive.



1. Budget travel enables better interaction with local culture than does luxury travel.



2. Budget travel is more sophisticated than luxury travel.



3. Budget travelers are more creative than luxury travelers.



I'll anticipate a few knee-jerk criticisms and try to answer them here in advance. Obviously not all budget travelers are savvy. Many are in fact the opposite. But it is just as certain that many, many (most?) luxury travelers are not at all sophisticated--not truly and fully in the spirit of cultural engagement and courageous exploration.

The testemony is informative. Here’s part of the conclusion:


In short, then, although it is not my place to make specific recommendations to this Subcommittee with regard to how the Espionage Act might be updated, it seems clear that the current state of the law is counterproductive regardless of the specific policy goals one might seek to pursue. As Judge Ellis observed in the AIPAC case,


The conclusion that the statute is constitutionally permissible does not reflect a judgment about whether Congress could strike a more appropriate balance between these competing interests, or whether a more carefully drawn statute could better serve both the national security and the value of public debate. . . . [Changes in the nature of threats to our national security over the last few decades] should suggest to even the most casual observer that the time is ripe for Congress to engage in a thorough review and revision of these provisions to ensure that they reflect both these changes, and contemporary views about the appropriate balance between our nation’s security and our citizens’ ability to engage in public debate about the United States’ conduct in the society of nations.


To that end, if Congress were ultimately to conclude that the Espionage Act should be limited to cases of classic espionage and perhaps other malicious disclosures of classified information, my suggestion would be to focus carefully on the mens rea in the statute, and to consider the adoption of something akin to a specific intent requirement—that the offender not just know that the disclosure would be harmful to our national security, but that he or she actually intend such harm. If Congress were ultimately to conclude that the Espionage Act should instead apply to all cases of legally unauthorized disclosures of classified information, then my view is that much of the current statutory language is superfluous and unnecessary, and that a far simpler prohibition, combined with clear indicia as to the provision’s scope, would avoid the myriad vagueness and overbreadth issues that currently plague the statute.

As 2010 winds down, your April 2011 self will thank you for making some moves to lighten your tax bill and set your finances in order for the year ahead. Decisions you make in the next few weeks will have implications that last for months.



Yahoo Finance dishes up some savvy choices that will pay off as Father Time finally pulls the plug on the tortured year.



The article recommends maxing out charitable giving and contributions to retirement accounts in order to decrease your exposure to higher tax brackets, as well as maxing out tax-free retirement contributions and taking any vacation days that won't roll over into the next year.



Perhaps the most valuable piece of advice is to get organized. Culling together appropriate receipts and statements and setting them aside so they aren't mixed with stuff from next year will pay off when the tax crunch arrives.

As we’re all well aware, Facebook doesn’t offer an iPad app. Well, maybe we’re not all so aware of that. Because Friendly, an unofficial app made by Oecoway, has been a massive hit on the platform. In fact, it has over 500,000 active users, co-founder Cyril Moutran tells us. And that’s pretty amazing considering that they have been charging for the app. But you can probably expect that number to explode even further, as they’ve decided to make the app free.


To be clear, there will still be a $0.99 version of Friendly, but the only difference from the new free version is that it won’t have ads. Undoubtedly, most users won’t care about that and will opt for the free version. And the app will rack up even more downloads because 1) again, Facebook doesn’t have an official app and 2) Friendly is a very solid way to use Facebook on the device.


We’re making Friendly for Facebook free, because we want to expand our user base and put Friendly for Facebook in as many people’s hands as possible,” Moutran says. The service essentially takes the touch-optimized version of Facebook’s site and wraps it in their own native app wrapper. But this allows them to add more functionality, such as the ability to change fonts and colors. Plus you can browse the web within it and quickly share back to Facebook. You can also easily manage multiple Facebook accounts from the app.


The app also brings a native app look, feel, and performance to Facebook. That may not sound like much, but given the usage numbers, it definitely can’t be overlooked.


But while Friendly is very good, let’s be honest: if Facebook had their own app, most people would likely use that. People currently searching for “Facebook” on the iPad only have the third-party options — and this has tricked some people. And considering that many of these apps are paid apps, that has cost people money — something which Facebook can’t like too much.


So did Facebook pressure Friendly to go free? It doesn’t seem that way. Moutran says that Facebook has been very supportive of what they’ve been doing. “The Facebook Platform team in particular deserves kudos for their around the clock dedication at providing help and guidance to developers on iOS SDK,” he says.



Maybe we should take Friendly going free as a sign that an official app is coming? That also doesn’t seem all that likely given Facebook CEO Mark Zuckerberg’s recent words about the possibility.


While Moutran declined to talk about their revenue numbers, if you simply take the 500,000 user number and multiply it by the one dollar the app had sold for, you get $500,000 (before Apple takes their 30 percent cut). Of course, Moutran did say the 500,000 is active users, so it’s possible the app has been downloaded quite a bit more, bringing Oecoway even more money.


Now they’ll likely have to replace a lot of that money with ad revenue. Will it add up? Who knows, but this move will undoubtedly bring them a lot more users.


We’re really excited because Friendly for Facebook has been an extremely successful paid application. It’s held the top overall spot for paid applications for more than 40 days, and it’s been the top paid social media iPad app since we launched version 1.0. But we want as many people as possible to be able to experience Friendly for Facebook so that’s why we are making it free,” Moutran reiterates.


That’s great news for Facebook users and iPad lovers alike.
